The Claimant alleged that she suffered damage to her motor vehicle as she was driving into a nursery when the access control bollards were not operating correctly. The Claimant alleged that the bollards suddenly raised when she drove over them.
The Defendant produced evidence from the engineer who conducted the post accident inspection which showed that the bollards were operating correctly and that no fault could be found with the bollards.
The claim was dismissed at trial as the Defendant could not have taken any steps to avoid the accident as the bollards were shown to be operating correctly.
