The Claimant alleged that her foot was caught in a defective drain on the carriageway causing her to fall and suffer injuries to her knee, calf and elbow.
The drain was broken and admittedly defective however the Defendant noted suspicious circumstances surrounding the claim as another similar accident involving the same drain had been reported by another family member at the same time. Allegations of fraud were made in the Defence and soon after witness statements were exchanged the claim was discontinued.
